When does a Child Custody Order end? Generally, it will continue until the child is 18, or 19 but still in high school, is legally emancipated, dies or if the custodial parent dies. If that happens, then custody is awarded to the living parent. Custody can also be changed by further order of Court. However, there are two standards which affect the evidence needed to persuade the Court.

It can be changed if it is in the best interests of the child or upon a showing of a substantial change of circumstances. The latter standard applies if the last custodial order is a “Montenegro” order.

This may not apply to a situation where you are not seeking a change in the custody designation but are only seeking changes to the custody schedule. Custody orders can be complicated as sometimes, the Court does not specify its intent.
